Discipline regarding sales terms and conditions
These sales conditions discipline the sale of the commercialized products by Eurocab through its own e-commerce website.
The purchase of the products through contracts concluded on the website and with the methods specifically provided are disciplined by the following sales terms and conditions, which operate in accordance with the legislation in force
The eventual adoption of new terms and conditions that replaces, modifies or integrates such terms is effective from the moment it’s published on the website.
Process for the conclusion of the contract
Electronic sales contracts of the products advertised on the website are concluded by:
- e-mail negotiation, regarding one of the products published on the website.
By forwarding the purchase order through the website or concluding by e-mail negotiation, the customer declares to have read and accepted the sales terms and conditions, which form an integral part of the contract and are fully binding from the moment of the order acceptance by Eurocab.
In case of purchase through the website, the correct receipt of the order is confirmed by Eurocab through e-mail, sent to the e-mail address reported by the client. This confirm message will report date and time of the receipt and an order number, to use in any further communication with Eurocab regarding the order.
The acceptance of the website order from Eurocab is confirmed through e-mail communication to the e.mail address the customer provided within 3 days from the receipt of the order. After 3 days without the express sending of the acceptance of the order by Eurocab, the same, in the absence of communications of opposite or incompatible content, must be understood as having intervened tacitly.
Product availability is purely indicative and refers to the warehouse stock data.
If the product goes out of stock, even after the order confirmation, Eurocab will provide an immediate rectification for the customer.
Every information in support of the products reproduce the ones provided by the manufacturer, and the customer purchases the products as described in the data sheets. The images on the website are provided solely for illustrational purposes to facilitate the recognizing of the products.
Eurocab preserves its right to change information, images and product prices without necessarily sending communications about it.
Public prices don’t include any taxes or duties applicable in the destination country of the products and/or services whether it’s different from Italy. Those prices, different in every country, are on behalf of the customer, that has the burden to verify the amount with the competent customs authorities.
Every product purchased is guaranteed up until 12 months from the delivery date.
Method of payment
The customer can use different methods of payment indicated in the purchase procedure. Any additional costs caused by a determined method of payment (for example: 3% for PayPal, 2% for cash on delivery with a minimum amount of 3€) is on behalf of the customer, and are expressly indicated in the purchase procedure.
Eurocab entrusts the delivery of the products to the delivery address indicated in the order form to specialized couriers. The shipping charges, subject to exceptions, are on behalf of the customer, and are indicated within the order.
Depending on the merchandise destination, the products are generally from the order acceptance on Italy’s territory. In case of deliveries out of Italy, a communication will follow regarding the shipping times. In case of unexpected obstacles, the shipping of the products is confirmed anyway within 30 days from the acceptance of the order. Whenever the products requested are not available, such circumstance will be transmitted to the client with the refund of the price paid. The customer guarantees the collection of the merchandise.
The Customer is required to check the integrity of the merch upon receiving and, in case of doubt, to indicate at that time any defects and damage on the delivery. From the delivery of the products, the customer is responsible for any damage or accidental destruction, happened after the delivery.
The customer must verify the correspondence of the merch with the one ordered and its integrity, and any complaints must be immediately indicated to the carrier In case the merch is not contested upon receival, it is considered correctly shipped and delilvered.
Eurocab is not responsible for any damage or further costs other than the ones regarding the return of merch not compliant to the ones ordered or damaged and the refund.
Right to change the order and right of withdrawal
The customer has the right to change the order (forwarded on the website) within 24 hours from sending the order, even whenever this has already been accepted by Eurocab, and even in a later moment whenever the products have yet to be shipped.
The Customer has the right to withdraw from the contract exclusively for cases of non-correspondence or damage to the goods received, provided that the circumstance have been promptly reported to the carrier and, in any case, within the peremptory term of 14 days upon receival.
The exercise of the right of withdrawal takes place by returning the goods and consequent refund equal to the purchase price net of shipping costs.
To exercise the right of withdrawal, the customer is required to communicate, within 14 days upon receival, its intention to withdraw with a written declaration complete with precise motivations.
The customer is responsible of the diminished value of the merch resulting after a manipulation other than the one necessary to establish the nature, characteristics and quality of the product.
Upon successful exercise of the right of withdrawal, the Customer will be refunded for any payment in execution of the contract, (except for the additional costs deriving from the possible choice of a type of delivery other than the least expensive among those made available by Eurocab), within 14 days following receipt of the notice of withdrawal and the successful return of the order by the Customer.
The refund is made through bank transfer on the bank accountindicated by the customer, with no additional costs, upon successful return of the ordr by the customer.
Please note that the products that get damaged or used, even partially, can’t be refunded or replaced.
Applicable law, negotiation clause and jurisdiction.
Every sales contract concluded on the website by Eurocab and the Client are to be intended as concluded in Italy and are governed by the Italian Law.
Any dispute arising from or connected to contracts concluded through the site between Eurocab and the Customer must first be the subject of an assisted negotiation attempt pursuant to D.L 12th of Semptember 2014 n. 132 converted in L. 10 november 2014 n. 162 e s.m.i.
For any legal dispute, the competent forum is set in the Court of Bologna.
